Our CC & Rs provide that each owner for maintanance of its pipelines and sewage charge is out of the house, even if some of these tubes are in the common area. The Hoa has also repeatedly stated that they have trees in the common area and no one can cut or fell. My sewer line was intact, and the roots of the tree that grew in the higher and lower over time began to grow around the pipeline under the seal of the country and take cast iron pipe. Plumbers had to break the tube replaced. My Hoa said that the trees do what they do, and because the trees are Maintanance wastewater, are the responsibility of luck. And they refuse to take down the trees. The HOA is appealing to the CC & Rs and California Penal Codedeny our right to have both the owner responsible for maintaining the water draw. The HOA is responsible. Why? The tree is on common ground and shared responsibility for all the homeowners association.
